摘 要
建设“一带一路”,是以***同志为总书记的党中央主动应对全球形势深刻变化、统筹国内国际两个大局做出的重大战略决策,它对推进我国新一轮对外开放和沿线国家共同发展意义重大。地处古代南方丝绸之路要道的云南,拥有面向“三亚”(东南亚、南亚、西亚)和肩挑“两洋”(太平洋、印度洋)的独特区位优势,是“一带一路”建设中的战略支点。为深入贯彻落实党的十八大精神,支持云南省加快建设面向西南开放的重要桥头堡,积极探索跨境金融改革创新,推动沿边地区和民族地区经济金融和谐发展,2013 年 11 月,经国务院批复同意,中国人民银行、中国保监会等 11 个部委联合印发了《云南省广西壮族自治区建设沿边金融综合改革试验区总体方案》(银发〔2013〕276 号)。总体方案明确提出,要大力推进保险市场发展,积极开展双边及多边跨境保险业务合作,大力推动中国与东盟和南亚国家在机动车辆保险、货物运输保险、出口信用保险、工程保险、旅游保险等领域的交流与合作,为对方国家保险公司在本国开展风险评估、资信调查、查勘定损提供便利。
随着国家“一带一路”战略和“桥头堡”建设的逐步深入,特别是云南省对东盟国家经济贸易和双边文化旅游交流交往的不断扩大,在服务云南乃至国家沿边开发开放战略中如何更好地发挥保险风险补偿、资金融通和社会治理的功能作用,开展具有云南特色、结合云南省实际的跨境保险业务创新显得十分重要和紧迫。然而,云南跨境保险如何走出一条可持续发展、规模化发展、创新发展的道路呢?本文在实地考察的基础上,运用文献研究法、规范性理论分析法、实证分析法等研究方法,依托“一带一路”战略,聚神现代保险服务业的功能作用,聚焦云南省跨境保险业务的创新实践,聚力服务云南沿边开发开放;同时,以云南沿边跨境保险试点探索和理论创新为经验,推动全国跨境保险、涉外保险更大范围的实践创新,有效地服务国家“一带一路”战略,探索建立“有市场、有政府、有机构、有产品、有合作、有覆盖”的全方位跨境保险市场体系。

Abstract
Constructing “one belt and one road” is a major strategic decision to activelyresponse to profound changes of global situation and plan the overall domestic andinternational situation as whole made by the CPC central committee which is led bycomrade Xi Jinping as general secretary. It has great significance for promoting a newround of opening up in China and the common development of countries along theborder. Yunnan, which is located in the ancient southern silk road route, with uniquegeographical advantages including facing “Three Ya” (southeast Asia, south Asia,west Asia) and adjoining “Two Oceans” (Pacific Ocean, Indian Ocean), is the strategicfulcrum of constructing “ one belt and one road ”. To further carry out the party's 18thParty Congress spirit, support Yunnan province to become the important bridgeheadof speeding up the construction to open to the southwest, actively explore the reformof cross-border financial innovation, and promote the harmonious economic andfinancial development of border areas and ethnic minority areas, in the November of2013, after being approved by the state council, 11 ministries and commissionsincluding People's Bank of China, China Insurance Regulatory Commission and otherministries jointly issued “The Construction of Border Areas' Financial ComprehensiveReform Pilot Area Overall Plan in Guangxi Zhuang Autonomous Region, YunnanProvince, ” (Yingfa [2013] no. 276)。In the overall plan, it's clearly put forward that topromote the development of insurance market, actively develop bilateral andmultilateral cooperation, cross-border insurance business, vigorously promote Chinaand ASEAN and south Asian countries' exchange and cooperation in motor vehicleinsurance, cargo transportation insurance, export credit insurance, engineeringinsurance, travel insurance and other fields, and provide convenience for nationalinsurance company for each other in their own country in risk assessment, creditinvestigation and survey fee.
As the gradually thorough of national strategy “ one belt and one road ” and“bridgehead” construction, especially when the bilateral economic, trade, cultural andtourism exchange association with ASEAN constantly expand in Yunnan province, it'svery important and urgent that how to develop insurance risk compensation, financingand social management functions better in service in the strategy of serving Yunnanprovince and even the national border development and opening-up, and carry outcross-border insurance business innovation with Yunnan characteristics, combiningwith the actual situation in our province. However, for cross-border insurance inYunnan, how to pave out a sustainable developing, scale developing and creativedeveloping road? In this paper, on the basis of on-the-spot investigation, it uses thetheory of literature research, normative analysis, empirical analysis and other researchmethods, relying on the “ one belt and one road ” strategy, focusing on the functionsof modern insurance services, the innovative practice of the cross-border insurancebusiness in Yunnan province and the cohesion service development of border areas inYunnan province; At the same time, taking border areas in Yunnan cross-borderinsurance pilot exploration and theoretical innovation as experience, it promotes awider range of national cross-border insurance, foreign insurance practice innovation,and effectively serves the national “ one belt and one road ” strategy, to explore andestablish cross-border insurance market system that covers the full range with “thegovernment , the institutions, the product, the cooperation and the coverage”.
