[摘 要]
党的十八大报告首次对生态文明制度建设的要求做出了概况，指出建设生态文明必须以制度为保障，充分发挥制度的引导与规范性作用。循环经济作为生态文明的重要领域，也是我国经济发展的基本途径，在制度方面的建设至关重要。循环经济制度建设是发展循环经济的制度保障和基础，循环经济的实现离不开制度，完善的制度能够促进经济的健康发展，对于这种新型经济发展模式，只有拥有一套完善的制度作保证，才会走出一条适合我国可持续发展的道路。
论文主体结构共分三部分：第一部分对循环经济及生态文明的内涵做出了概述，指出循环经济与生态文明之间的关系，并在此基础上阐述了循环经济制度建设的内涵。通过对马克思相关思想的整理，得出循环经济制度建设在我国的循环经济建设、生态文明制度建设以及我国的经济建设方面具有重要的意义。第二部分是从法律、政府、企业与公众的角度出发，依次对其在循环经济制度建设中出现的问题进行概括。在相关循环经济的法律方面，主要从立法、执法与司法层面出现的问题进行研究；政府方面的问题是从政府的管理与引导以及市场机制方面进行概括；企业上主要是从企业对循环经济的认识、转变等方面的制度进行研究。最后是循环经济的公众参与方面的制度问题，主要以公众对循环经济的认识、监督等方面为主。第三部分通过研究对我国循环经济的法律、政府、企业和公众方面存在的问题做出相应的对策。在立法上要不断进行修改与完善，对原有的法律进行补充，使各项法律、法规相互协调以促进循环经济发展；在执法与司法方面，要建立多部门的联合执法，加大处罚的力度以及监督机制等，并在环境诉讼的主体上、当事人的确定等方面加以完善。政府管理在循环经济制度建设中至关重要，为减少更多的错误决策，建立完善的政绩考核与责任追究制度以及完善的绿色采购制度十分必要，使激励与优惠政策更加完善，从而引导企业与公众进行参与；从完善我国的生态补偿制度、排污权交易机制等方面来健全我国的循环经济市场机制。企业与公众是循环经济制度建设中的实践主体，教育与宣传必不可少，在企业内部进行清洁生产加速企业的内部转型，并通过信息披露以及建立中介组织等措施来更好地促进循环经济发展。

ABSTRACT
The party 18 report for the first time made a summary to the requirement of constructionof ecological civilization system, points out that the construction of ecological civilizationmust take system as guarantee, give full play to the guidance and standardization system.Circular economy as an important field of ecological civilization, also is the basic way ofeconomic development in China, in the construction of the system is very important. Circulareconomy system construction is the basic and the system guarantee of the development ofcircular economy, the implementation of circular economy, for the new economicdevelopment model, only have a perfect system for guarantee, will come out a way suitablefor the sustainable development of our country.
The main structure of the paper is divided into three parts: the first part of theconnotation of circular economy and ecological civilization, points out the relationshipbetween circular economy and ecological civilization, and on this basis the paper expoundsthe connotation of circular economy system construction. Based on Max's thoughts ofconsolidation of circular economy system construction in our country's circular economyconstruction, the construction of ecological civilization system and our country's economicconstruction has important significance. The second part is from the angle of the law,government, enterprises and the public, in turn to their problems in the construction ofcircular economy system are summarized. In the related legal aspects of circular economy,from the aspect of legislation, law enforcement and judicial problems in the study; Problemsof government management and guidance from the government and the market mechanism togeneralize; Enterprises mainly from the enterprise on understanding of circular economy andtransformation of system is studied. The past of public participation in the circular economyis the problem of system, mainly public awareness of the recycling economy, supervision, etc.The third part through the research on our country's circular economy law, problems in thegovernment, enterprises and the public to make corresponding countermeasures. To modifyand perfect in the legislation, to supplement the original law, the laws and regulations tocoordinate with each other to promote recycling economy development; In the aspect of lawenforcement and judicial, we should establish multi-sectoral joint law enforcement, intensifypunishment and supervision mechanism, etc. and on the subject of environmental litigation,consummates aspects and so on the determination of the parties. Government management inthe construction of circular economy system is crucial, in order to reduce more bad decisions,and establish a perfect system of achievements assessment and responsibility as well as theperfect green purchasing system is necessary, so as to further perfect incentives andpreferential policies, so as to guide enterprise and public participation; Consummates ourcountry's ecological compensation system, from the aspects such as emissions tradingmechanism to improve the market mechanism of circular economy in our country. Enterprisesand the public is the practice subject in circular economy system construction, education andpublicity is indispensable, cleaner production in enterprise internal accelerate enterpriseinternal transformation, and through the measures such as information disclosure andestablishing intermediary organizations to better promote the development of circulareconomy.
