摘 要
自我国实施依法治国以来，安全生产水平已经有了显着提高，但仍存在一些不足，其中最突出的问题就是对行政监管的过度依赖与持续强化，而对其他社会治理力量的参与及法律保障不足。如劳动力市场尚未建立劳动工资风险补偿金机制、中介服务市场法律法规不健全、商业保险缺位、企业贷款缺少安全生产条件评估等。本文首先对影响安全生产的市场推动作用进行理论分析，从劳动力市场、中介服务市场、资本市场、保险市场以及企业社会责任这五个主要方面中寻找解决安全生产问题的突破口。其次，介绍并分析了美国、英国和德国在安全生产治理中如何成功运用这些市场机制以及相关的立法和执法实践，给我国的安全生产以重要启示，即在坚持政府监管的前提下，充分吸纳和利用有益的市场因素，建立配套的法律保障机制来改革并完善安全生产监管工作。据此，本文分析了我国安全生产市场推动机制法律保障的不足，提出建立劳动工资风险补偿金法律保障机制以保障劳动力市场，健全中介服务市场法律保障机制以规范中介服务市场的推动作用，推进商业保险立法以促进保险市场推动作用的发挥，建立企业贷款信用安全等级制度规范资本市场，完善企业社会责任立法加强企业安全生产责任，形成保障安全生产的“第二线法律”.

Abstract
Since China's implementation of the rule of law, the level of safety productionhas been significantly improved, but there are still some shortcomings, one of themost prominent problem is over-reliance on the continued strengthening ofadministrative supervision, but does not think highly of the other social governanceforces as well as the legal protections. For example, does not establish the wagesrisk compensation in the labor market, laws and regulations of intermediary servicemarket are not perfect, absence of commercial insurance, lacking safety conditionsassessment about business loans. Firstly, analyzing the theoretical of the market thatmay affect the safety of production ,from the labor market, intermediary servicesmarket, capital market, insurance market and corporate social responsibility, the fivemajor aspects of production problems in finding solutions to the safety production.
Second, introducing and analyzing the United States', Britain's and Germany'sexperience in production safety management about how to successfully apply thesemarket mechanisms and related legislation and law enforcement practice, and withimportant implications of the safety for our production, that is, at the insistence of thepremise under government regulation ,fully absorbing and utilizing beneficial marketfactors, supporting the establishment of legal protection mechanisms to reform andimprove the supervision of. Accordingly, this paper analyzes the deficiency of thelegal protection about market-driven mechanism in the safe production , establisheswage risk compensation mechanisms to guarantee the legal protection of the labormarket, improves the legal protection mechanisms of intermediary service market toregulate the intermediary service market, establishes the credit safety rating system ofcorporate loan to regulate the capital market, improves the legislation of corporatesocial responsibility to strengthen the responsibility of production safety, to form the“second line of law” to ensure the safe in production.
