中国安全生产培训法律制度的缺陷探析

  摘 要
  
  我国的安全生产培训法律法规基本形成了一个完整的体系,但是安全生产培训制度并不健全。安全生产培训经费保障不足、安全生产培训档案法律制度不健全将难以保证从业人员的受训权。安全生产培训法律制度缺少三方合作机制、安全生产培训法律制度的监管不完善使安全生产培训法律法规在执行过程中不可避免的出现执法不严,惩处失衡的问题。安全生产培训法律制度的救济手段缺失又使从业人员的基本生命权难以得到很好的维护。对比美国、日本和德国的安全生产培训法律法规,美国建立了独立的安全生产培训机构保障安全生产培训工作,日本出台专项规章保障高龄工人的培训,德国利用多种渠道筹措培训经费都使安全生产培训工作得到了良好的保障。我国虽同发达国家国家体制不同,但是我们可以有所取舍的借鉴一些好的制度用于我国的安全生产培训法律法规中,从而保障安全生产培训工作顺利开展,保障从业人员的受训权,保障公民的生存健康权,保障经济社会的持续健康发展。据此,本文提出了建立安全生产培训领域的三方合作机制,建立高龄工人的安全生产培训制度,完善安全生产培训档案制度,利用多方渠道募集安全生产培训经费,建立安全生产培训惩罚性赔偿救济法律制度等建议。

  Abstract
  
  The training of our laws and regulations system of work safety is basicallyformed a complete system, but in the specific provisions of training legal system isnot perfect. Lack of work safety training funds, guarantee work safety training filesperfect legal system will be difficult to ensure the right of workers training. The legalsystem of work safety training lack of cooperation mechanism, the three partysupervision of work safety training of the legal system is not perfect so that thetraining of work safety laws and regulations in the implementation process of theinevitable emergence of lax enforcement of the law, punish the imbalance problem.
  
  The training of legal system of safe production relief means missing and makeworkers' basic right of life is difficult to obtain the very good maintenance.
  
  Comparison American, Japanese and German training for work safety laws andregulations, America to establish an independent work of work safety training securitywork safety training institutions, Japan issued a special rules and regulations toprotect older workers training, Germany to use various channels to raise trainingfunds make work safety training to get good protection. China is different with thedeveloped countries in the state system, open and inclusive today, we can have achoice of some good reference for our country's system of work safety training inlaws and regulations, so as to guarantee work safety training work smoothly, protectworkers trained right, safeguard the citizen's living health right, safeguard economicsociety continues the healthy development of. Accordingly, this paper proposes safetytraining system establishment of elderly workers, improve the training archivessystem of safe production, establish the cooperation mechanism of the three partytraining areas of production safety, the use of multiple channels to raise work safetytraining funds, the establishment of safe production training legal relief legal systemrecommendations.
