5 结论
安全生产问题一直是我国经济发展中的突出问题，是政府的重要责任之一，已经被提升到安全发展观的理论高度。我国政府在安全生产规制中最突出的特征就是对行政监管的过度依赖与持续强化，而对其他社会治理力量参与的重视不足。国内关于安全生产的研究基本上没有突破政府监管的传统界限，关于市场推动机制的研究也鲜有论述。而国外对于安全生产的市场推动机制已经有了比较成熟的认识，即在坚持政府监管的前提下，充分吸纳和利用有益的市场因素，改革并完善安全生产政府监管工作。
本文通过对影响安全生产的市场因素进行理论分析，深入挖掘国外在安全生产立法和执法实践中充分运用市场机制的治理经验，分析我国社会主义市场经济条件下安全生产的市场推动机制的构成因素及其作用机理，我国应充分借鉴发达国家在治理安全生产中的成功经验，充分发挥市场机制在自我调节中的重要作用，从劳动力市场、中介服务市场、资本市场、保险市场等市场中寻找解决安全生产问题的突破口，并对施以法律规范，引导企业走向自律模式。构建与之相配套法律保障机制，形成确保生产安全的“第二线法律”,为我国安全生产监管的改革与转型提供有益的法律建议。要使市场推动力量充分发挥作用，离不开法律的保障，只有将这些推动因素归入立法和执法当中，才能确保其合法化和正当化。
本文研究的直接目标是解决当前安全监管乏力问题，长远目标则旨在构建我国安全生产行政监管与市场推动机制互相衔接的治理模式，实现政府监管与市场推动的良性互动。
