摘要
人类对法律的认知大致经历了从宗教法律观到理性法律观再至国家法律观最后至当下的社会法律观这样一种过程,这是一个对法律的认知不断理性、深化的过程。及至当下颇受关注的社会法律观,它反映了人类对法律更为深刻的理解,基于这种法律观,在某种程度上,法律与宗教无关,与理性无关;也在相当程度上,法律与国家无关,法律是社会之物。社会法律观是法社会学派或者说社会法学派对法律所持有的一种基本的观点,而论及法社会学则不能不提尤根·埃利希作为法社会学的奠基人,埃利希对法社会学的诞生和发展都功居至伟,其卓越着作《法律社会学基本原理》一书则为法社会学领域中的不朽经典。埃利希将社会学的理论和方法引入到法学研究之中,拓宽了法学研究的视域,更新了法学研究的方法,这被视为其对法学研究卓越而永恒的贡献。在笔者看来,埃利希最伟大的贡献则在于其创建、发展了一门迄今最为纯粹、最为彻底的法社会学。
本文主要建构于对埃利希的不朽着作《法律社会学基本原理》的文本解读的基础之上,通过对文本的解读、梳理以及结合其他理论和中国语境来探究埃利希的法社会学思想,力图较为客观而详尽地呈现埃利希法社会学思想的全貌。
本文除绪论、结语部分之外,正文分四部分来撰写。第一部分主要考察埃利希埃利希法社会学思想产生的社会历史背景和思想理论渊源,本部分主要从作为特定时空的法律人、现实诉求与理论回应、借鉴运用与批判继承三个层面来论述。第二部分为本文之核心章节,着重梳理、阐述埃利希之法社会学思想的主要内容。该部分分别从本体论、价值论、方法论、社会论四个方面来透视埃利希的法社会学思想理论。第三部分主要探索埃利希法社会学理论中所蕴涵的历史唯物主义思想,以此来说明埃利希对历史唯物主义法律观在某种程度上、在某些方面的继承与发展,并在此基础上审视埃利希法社会学思想的科学性。第四部分分别从历史文化和地域民族两个层面将中国语境下的法律置于埃利希法社会学法律观的视角下进行考察和检视,反省中国“自己的”法律。
本文的创新之处主要体现在以下若干方面:其一,在绪论部分的国外国内研究状况部分,较之于之前的相关主题论着笔者增添了更为新颖、丰富、详实的材料。其二,在论及埃利希法社会学思想的产生时,笔者专节考察了埃利希其人。埃利希的家庭出身、知识结构、文化层次、宗教信仰、人生境遇、生活环境、社会阅历、职业履历等都对其法社会学思想的产生有着至关重要的影响。其三,在讨论埃利希法社会学思想理论渊源时,笔者引入了埃利希颇为赞赏的祁克的社会联合体等相关理论。其中,埃利希对祁克的社会联合体理论加以扬弃,提出了其独具特色的社会联合体的概念,这一概念构成了埃利希《法律社会学基本原理》一书的最为核心的概念之一。其四,笔者在本文的第四章尝试着探索埃利希法社会学理论中所蕴含的的历史唯物主义思想。埃利希强调法律秩序、法律关系、活法源于社会法律事实、强调法律取决于社会经济状况;而历史唯物主义则强调社会存在决定社会意识、经济基础决定上层建筑的基本哲学理念之下社会、经济对法律决定作用;二者之间这种微妙的关系则构成了笔者审视埃利希法社会学思想的历史唯物主义蕴涵的主要动机。其五,在本文的第五章,笔者简要地审视了埃利希法社会学视角下中国语境中的法律,这种审视不仅有对中国少数民族地区社会、法律的考察,更有对中国古代历史上受儒家思想文化支配的汉民族地区社会、法律的考察,而这种考察对以更为客观、公正的眼光来审视“中国自己的”法律不无裨益。鉴于第四、第五两章为探索性、尝试性的写作,文中瑕疵之处或许自当难免。

Abstract
The human's cognition of the law has undergone some changes from religiousnotion to the rational notion and then to the country notion and finally to the currentsocial notion such a process, which is a constantly rational and deepening cognitiveprocess of the law.As for the high-profile social notion of law currently, it reflects themore profound human's cognition of the law, and based on this kind notion of law, tosome extent, the law is irrelevant to religion, irrelevant to ration ;Also in a greatextent, it has nothing to do with the national law, law is the thing of the society .Socialnotion of the law is basic point of view which is held by sociological school oflaw.When it comes to sociological jurisprudence ,we must discuss Eugen Ehrlich.Asthe founder of sociological jurisprudence, Ehrlich contributes a lot to the birth anddevelopment of the sociology of law ,his excellent work《fundamental principles ofthe sociology of law》is immortal classic in the field of law sociology.Ehrlichintroduces the theories and methods of sociology to law study, broadening the visionof the jurisprudence, updated the research methods of the jurisprudence, which is seenas his excellent and eternal contribution to the legal research .In my opinion, Ehrlich'sgreatest contribution lies in that he has created and developed a most pure and radical sociology of law.
This thesis is based on the text interpretations of Ehrlich's masterpiece《fundamental principles of the sociology of law》,through the interpretations andcombs of the text and combined with other theories and Chinese context ,the authorattempts to explore Ehrlich's thoughts of sociology of law and tries to presentobjective and detailed Ehrlich's thoughts of sociology of law as a whole.
In this thesis, besides introduction and conclusion part, the text is divided intofour parts to write.The first part mainly inspects the social and historical backgroundand thoughts origin of Ehrlich's law sociology thought theories,this part mainlydiscuss about Ehrlich as a legal person in a particular space and time, reality demandsand response theories, reference for utilization and critical inheritance such threeaspects.The second part is the core part of this thesis, emphatically combing andexpounding the main content of Ehrlich's law sociology thoughts.This partperspectives Ehrlich thoughts and theories of sociology of law respectively from thetheory of ontology, value and methodology, society four aspects .The third part ismainly to explore the historical materialism thoughts in Ehrlich's sociological theoriesof law, in order to explain Ehrlich's inheritance and development to the notion ofhistorical materialism to some extent, and based on this review,to survey thescientificity of Ehrlich's law sociology thoughts.The fourth part puts the laws of theChinese context in the perspective of Ehrlich's sociological law notion ,which areinspected and reviewed respectively from two aspects of historical culture andregional ethnic ,reflects on the “own” law of China.
The innovations of this thesis is mainly manifested in the following severalaspects: first, in the introduction part of foreign and domestic research status,compared with the previous related theme works ,the author adds more novel, richand detailed materials.Secondly, in regard to the produce of Ehrlich law sociologythoughts,the author inspects Ehrlich with a separate section. Family background,knowledge structure, cultural level, religious belief, life situation, living environment,social experience, professional resume have a crucial impact on Ehrlich's thought ofsociology of law.Third, when discussing the thought theory origins of Ehrlich's lawsociology,the author introduces Gierke's theory of social association which Ehrlichrather appreciated .Ehrlich sublates Gierke's social association theory and putsforward the concept of his unique social association, this concept constitutes the mostcore concept of 《fundamental principles of the sociology of law》 .fourthly, the authorin the fourth chapter of this thesis tries to explore the historical materialism thoughtsin Ehrlich's theories of sociology of law .Ehrlich emphasizes that legal order, legalrelationship, living law are the results of social law facts and law depends on thesocial and economic conditions;And historical materialism emphasizes that the socialexistence determines social consciousness, the economic base determines thesuperstructure ,based on the basic philosop场,the society and economy determine thelaw ;This delicate relationship between them forms the main motivation of the authorto survey the historical materialism thoughts in Ehrlich's theories of sociology oflaw .Fifthly, in the fifth chapter of this thesis, the author briefly surveys the law in thecontext of China based on Ehrlich's law sociology, this survey contains not only theinspection of the society and law of China's ethnic minority areas ,but also theinspection of the society and law of the ancient Chinese han nationality areascontrolled by the Confucian culture in the history ,and the inspection benefits tosurvey “China's own” law with a more objective and fair view. In view of theexploratory and tentative writing in he fourth chapter and fifth chapter,the defectsare possibly hard to avoid.
